General Terms and Conditions of Sale — Video capture and shoot coordination services

Waved Retreats (Hugo M Visual — micro-entrepreneur registered under SIRET number 84497070700015, NAF 5912Z — Film post-production), with its registered office at 05 rue de la Fléchouserie, contact: contact@waved.surf, hereinafter "the Provider".

Article 1 — Purpose

The purpose of these general terms and conditions of sale is to define the terms of the service offered by the Provider: video capture and logistical coordination of the shoot carried out during a surf retreat bringing together several participants.

The Provider does not organize or sell travel, stays, accommodation, transport, or surf lessons. These elements are provided by third-party providers independent of the Provider (hereinafter "Third-Party Providers"), with whom each participant contracts and pays for their service separately. Any booking of the video service implies unreserved acceptance of these conditions.

Article 2 — Independent third-party providers

The participant acknowledges and accepts that:

• surf coaching is provided by an independent coach, under their own responsibility, their own terms and conditions of sale, and their own insurance coverage;
• accommodation is provided by the owner or operator of the premises, under their own responsibility and terms;
• each of these services is subject to a separate payment, directly to the concerned Third-Party Provider.

The Provider does not intervene in any capacity in the execution, quality, safety, or cancellation of these third-party services, and cannot be held liable for any damages, injury, cancellation, or failure resulting therefrom. Any complaint relating to coaching or accommodation must be addressed directly to the concerned Third-Party Provider, under the conditions they have established themselves.

Article 3 — Nature of the video service

The Provider undertakes to film the participant's surf sessions during the agreed period, and to provide the logistical coordination necessary for the smooth running of the shoot (organizing filming slots with the coach, preparation of shooting equipment).

This service does not include passenger transport, supervision of surfing activities, or the provision of surf or yoga equipment.

Article 4 — Rates

The prices of the video service are net prices in euros, including French VAT if applicable. The Provider reserves the right to modify its rates at any time; the price displayed on the day of the order remains the only one applicable to the buyer.

Article 5 — Booking and payment

The confirmation of the video service booking constitutes acceptance of these terms. A 50% deposit is required to confirm the booking, payable via a Stripe payment link or in cash. The balance is due no later than the day of arrival.

The data recorded during the booking serves as proof of the transaction and its acceptance. An invoice can be issued upon simple written request to contact@waved.surf.

Article 6 — Cancellation

The participant may cancel their video service under the following conditions:

• up to 15 days before the scheduled date: the deposit is refunded, minus 1.5% for bank transaction fees;
• within 15 days preceding the scheduled date: the deposit is converted into a credit note.

Any cancellation must be notified in writing. This clause only concerns the video service; the cancellation of coaching or accommodation is exclusively subject to the conditions set by the concerned Third-Party Providers.

The Provider reserves the right to cancel or modify its service in the event of an external event beyond its control, in which case the deposit paid for the video is fully refunded.

Article 7 — Delivery of video content

The Provider undertakes to deliver the agreed rushes and/or edits within [X weeks] following the end of the shoot, in the format specified at the time of ordering.

Article 8 — Image rights

By booking the service, the participant authorizes the Provider to use the images and videos representing them, captured during the shoot, for communication and promotional purposes, without financial compensation, unless otherwise expressly agreed in writing.

Article 9 — Proof and archiving

The Provider archives bookings and invoices relating to the video service on a reliable and durable medium, in accordance with Article 1348 of the Civil Code and Article 286, paragraph I, 3° bis of the General Tax Code.

Article 10 — Governing law and disputes

These conditions are subject to French law. In the event of a dispute, an amicable solution will be sought before any legal action, at the address contact@waved.surf.
